www.sehataqua.co.id/aqua10liter/promo is a Website owned and managed by PT Tirta Investama, PT Tirta Sibayakindo, PT Sarihusada Generasi Mahardhika, PT Nutricia Indonesia Sejahtera, PT Nutricia Medical Nutritionand/or other companies that are affiliated with the Danone company in Indonesia (“AQUA”, “we”, “our” or “us”).

This Website can be accessed by Consumers (the “User”), to participate in promotion programs and/or interesting events related to AQUA Products, including AQUA 10L. Further provisions regarding User requirements refer to Number 4 of these Terms and Conditions.

The Terms and Conditions of this ApplicationWebsite are an integral part of other policies and regulations contained in the Website.

2. ABOUT THE WEB PAGE

This Website is a system where the User can use AQUA Promo features and other functions in accordance with the benefit of the Website.

Benefit of the Website:

This Website has the function to provide information about AQUA, AQUA programs, collect and store User personal data & submissions for point collection during the related Program.

How to access the Website.

This Website is accessed in the following ways:

  1. This Website can be accessed through browsers via the link address  www.sehataqua.co.id/aqua10liter/promo .
  2. The Website can only be accessed with User Account registered in accordance with the user requirements in Number 4 below.
  3. Users must comply with the requirements in Number 3 and 4 of these Terms and Conditions.

3. ACCOUNT AND SECURITY

Services on the Website can only be accessed with a registered User Account. In regards with the usage of the Website, You as a User agree and guarantee to:

  1. Keep the confidentiality of Website access, and are not allowed to forward in any way the email you receive in connection with the invitation to access the Website.
  2. Immediately notify AQUA of any unauthorized use of Your Account and/or password.
  3. Ensure that Your Account information is correct, accurate and the latest. You are fully responsible for all activities that has been done by using Your Account, even if the activity or use was not done by You. AQUA will not be liable for any losses or damages caused by unauthorized use of Your password or Your failure to comply with these terms.

You agree that for any reasons at AQUA’s sole discretion and with or without notification or policy to You or any third parties, AQUA can terminate Your Account and User Name/User ID and delete or remove any content related to Your Account and User ID from the Website. The basis for such termination can including, but not limited to:

  1. Inactive for a certain period of time; or
  2. There is a violation of the provisions of these Terms and Conditions and/or Terms and Conditions on the Promo ; or
  3. Committing forgery, illegal behavior, fraud, slander and/or any other law violations; and/or
  4. Behavior that caused losses to other User, third party, or AQUA’s business interests.

The use of the Account for illegal purposes, defrauding, slandering, threatening, violations of AQUA’s company regulations and/or any other law violations, can be referred to law enforcement without prior notification to You. If any legal issues arise or law enforcement action is taken related to Your Account or Your use of the services on the Website for any reason, can terminate Your Account immediately with or without prior notification.

You may delete Your Account by notifying AQUA of such intent. For further information, contact the Help and Support Section. Regardless of the deletion, the User remains responsible and liable for any unfinished transactions (whether started before or after the deletion).

AQUA will have no liability and will not be responsible for any losses incurred as a result of actions related to this. User waives any and all claims based on any such action taken by AQUA.

Regarding the use of the Website, You as a User agree and guarantee AQUA to:

  1. Keep the confidentiality of Website access, and are not allowed to share or disclose to other party in any way the email you receive to access the Website, without legitime purpose and prior approval from AQUA.
  2. Immediately notify Danone of any unauthorized use of Your Account and/or password.
  3. Ensure that Your Account information is correct, accurate and the latest. You are fully responsible for all activities that has been done by using Your Account, even if the activity or use was not done by You. AQUA will not be liable for any losses or damages caused by unauthorized use of Your password or Your failure to comply with these terms.
  4. You understand that any violations of the above warranties of this section is subject to sanction under relevant prevailing laws and regulations.

4. THE TERMS AND CONDITIONS OF THE USER

  1. The Website Users are as follows:
    1. To access information and/or participate in this Website, the User must login via url link;
    2. Access can only be done using the registered phone number.
  2. Services in the Website will be activated after the User logs in to the Website.
  3. Users are responsible for all activities that occur with the use of their name and account. Users are also responsible for notifying AQUA immediately if their name and/or account has been used illegally by other parties or other security breaches occur.
  4. Users are prohibited from misusing this Website and/or any access to this Website for prohibited matters in accordance with applicable policies and regulations in the Republic of Indonesia.
  5. We reserve the right at any time to ask the User to fix the User account if necessary for access security.
  6. By using this Website in accordance with the Terms & Conditions and Privacy Statement, You as a User have given your consent to AQUA for the purposes as further disclosed in the Privacy Statement.

5. TERMS OF USE OF THE WEB PAGE

This Website and all data in it may only be used by the User for AQUA 10 Liter Program, in order to comply with internal policies and/or requirements at AQUA and/or the applicable Distribution Agreement between AQUA and Distributor, by complying with all relevant Terms & Conditions and Privacy Statement.
  2. Users cannot distribute, modify, transmit or use the data in this Website for any general or commercial purposes, without AQUA’s prior written consent.
  3. The usage of this Website is at User’s personal risk. AQUA or other parties involved in the creation, production and/or management of this Website are not responsible for any direct, accidental, consequential, indirect or losses caused by accessing and using this Website, including but not limited to: damages, or viruses that may infect User’s computer or User’s mobile device. Without limiting the foregoing, everything in this Website is provided to users ‘as is’ without any guarantee of content or guarantee of its worthiness and fitness for particular purpose, or no guarantee of being free from law violations.
